Enchanted Kingdom, Inc. (“EKI”) endeavors to protect your personal information – your “Data”. This Privacy Policy (“Policy”) applies to how we collect, use and disclose your Data. You will be deemed to have read and accepted the terms of this Policy if you browse, view, visit, use or submit any Data to EKI.

A. COLLECTING YOUR DATA

We take the necessary steps to ensure that we do not collect more Data than necessary. For us to provide you with the best possible service, we may collect and process your Data as follows:

  1. When you seek to purchase our products and services. Your name, email address, home and/or office address, phone numbers, visual recordings, and other information (such as, but not limited to gender, birthdate, credit card information, payment information, medical history and condition, travel history and personal interests) as part of our transactions and dealings with you.
  2. When you apply for employment. Your resume, and details including, but is not limited to, your educational background and employment history.
  3. When you become our business partner. Your company information, and the information of your key personnel and your services and track record will be needed, when we engage you for business or commercial transactions.
  4. When you reach us on the Internet. Your internet, browsing and social media behavior, when you browse into our website, download mobile applications and tag or mention us on your social media accounts.
  5. When you share Data. Any information you submit or disclose to us through inquiries or requests, or when you participate in surveys, promotions, and special events, or any information you might share with us face to face or through our website and social media platforms. If you share with us another person’s Data (such as that of your spouse, child, and other family members), you represent that you are authorized to share that Data.
  6. When you visit our Park. Your name and identification documents, when you enter our Park or to access promotions, discounts or special events. For verification purposes, upon entry at Enchanted Kingdom, we may ask for presentation of proof of identity from you as needed. Your photos, by our third-party photo provider.
  7. CCTV data capture on cameras. As CCTV cameras are installed, your pictures and videos may also be recorded. To help us keep Enchanted Kingdom safe, we use CCTV cameras in strategic locations around our theme park.

The information we collect is covered by this policy, and the information collected by our partners is subject to our partner’s privacy policies.

If you do not supply such Data as may be requested, or if you withdraw consent you had previously given, we may be unable to –

  1. Provide your requested product or service orders, or deliver to you the products or services you have purchased or ordered from us, or provide assistance to you;
  2. Act upon or continue with any employment application or commercial proposal you may have submitted or intend to submit;
  3. Update you of our latest products, services, offerings, promotions or events; which you may be interested to know about and/or
  4. Provide you with the full functionality of our website and other facilities, and possible online transactions in the future.

B. USING YOUR DATA

When you provide us with any Data, this means that you authorize us to –

  1. Supply you the products and services that you ordered, including customer support, in a timely manner;
  2. Inform you about our latest products, services, offerings, promos, and events (only if you provided us with your consent);
  3. Respond to your requests, queries, assistance and other communications;
  4. Comply with any relevant law, rule, or regulation and all legal orders and processes;
  5. Perform and conduct due diligence for, and documentation of, our transaction;
  6. Process your Data;
  7. Conduct verification of your identity upon entry to the theme park;
  8. Develop, introduce, and improve current and new product and service offerings for guest experience;
  9. Provide assistance to you; and
  10. Any other purpose relating to any of the above.

If you do not wish to receive updates about latest products, services, offerings, promos, and events, please inform us by writing or sending an email to the Data Protection Officer.

C. SHARING YOUR DATA

We may also share your Data with –

  1. Our affiliates, to enable them to offer or improve their respective services or products;
  2. Our service providers, to the extent needed for them to perform their duties and functions;
  3. Government authorities, at their request and when legally required to do so; and,
  4. Purchasers or potential purchasers of our rights and obligations relating to the services it provides. In this case, Data we collect are regarded as assets transferable to third parties.

D. RETAINING AND DISPOSING YOUR DATA

We retain your Data for so long as necessary to fulfill the purposes for which your Data was collected, or whenever necessary to resolve disputes, enforce our policies or comply with legal requirements. To maintain the integrity and confidentiality of your Data, we put in place physical, technical and organizational safeguards to protect against loss, theft, and unauthorized access, disclosure, copying, use or modification. These safeguards include but are not limited to –

  1. Limiting access to duly authorized personnel; and
  2. Keeping the computers, servers, and other hardware where your Data may be stored in secured environments.

We delete your Data when no longer needed for the purposes for which it was collected and in the absence of any circumstance requiring their retention.

E. COOKIES AND RELATED TECHNOLOGY

Our website uses cookies enabling us to store information about the way you use our website. This information includes entries to form fields, such as names, addresses, passwords and user preferences. Some browsers can disable cookies but doing so may affect your browsing experience.

F. SPECIAL TERMS

Our Policy uses certain terms having a special meaning.

  1. When we “Process” your Data, we refer to any operation or any set of operations performed upon your Data including, but not limited to, the collection, recording, organization, storing, updating or modification, retrieval, consultation, use, consolidation, blocking, erasure or destruction of data, and outsourcing of these activities. Processing may be performed through automated means, or manual processing, if the information are contained or are intended to be contained in a system.
  2. When we “Share” your Data, we refer to our disclosure or transfer of the Data to other persons or entities but excluding outsourcing.

G. YOUR RIGHTS

The Philippines’ Data Privacy Act of 2012 grants you the right –

  1. To be informed whether your Data is being or has been processed.
  2. To request access to and correction, update, and change of your Data.
  3. To object to the processing of your Data.
  4. To suspend, withdraw, or order the blocking, removal or destruction of your Data; and
  5. To withdraw any consent you may have given at any time. “Consent” here means your consent to having your Data processed by us.

There may be instances where we cannot grant you access to the personal information we have. For example, we may need to refuse access if granting access would interfere with the privacy of others.

H. CHILDREN'S PRIVACY

In the course of delivering our service, we may have to Process the Data of a Child. The following supplements our Privacy Policy in respect of the Data of a Child.

We ensure that we do not Process the Data of a Child without the consent of a Parent. A “Child” means any person not of the age of majority or (regardless of age) one without capacity to act. A “Parent” means any person having parental authority, special parental authority, guardianship or legal responsibility over the Child. When the Child is of the age of majority but without capacity to act, the Parent must inform us of the special circumstances of the Child.

If the Parent consents to Processing the Data of a Child, the processing may relate to collecting, using, sharing, and retaining or disposing the Data. The Data may include biographical information such as or relating to the Child’s name, age, date of birth, address, contact details, and images or likenesses. A Child’s image or likeness may be used for promotional materials. For certain of our services, the Data may include information concerning pre-existing health conditions; information identifying or relating to a Parent or the Parent’s representatives; and images, likenesses or recordings of the Child. In relation to the Data, we may require the presentation or submission of certificates of birth or other legal documents.

If the Parent refuses to consent to the Processing of a Child’s Data, the Child (or the Parent, as the case may be) may be unable to access or benefit from the services for which the Data is required.

A Parent may exercise a Right recognized by this Policy.

CHANGES TO THIS POLICY

We may revise this Policy from time to time. We may also update this Policy to reflect changes of law or regulations, or our business operations and environment.
